General Terms and Conditions
Article 1 - Law System
This contract is subject to the status of tourist accommodation. On the one hand, the resident may not therefore invoke the legal provisions applicable to residential tenancies, notably with regard to security of tenure.
On the other hand, the residence may not be used as a place of domicile, on a private or professional basis.
The provisions of articles 1952 and following in the French Civil Code relating to hoteliers do not apply to the Victoria Garden residence. It cannot be held liable in the event of theft or damage to personal property in the suites, common areas, car parks and any other outbuildings or annexes to the establishment.
Article 2 - Reservation
The reservation of a suite in a Victoria Garden residence shall not be considered as valid until the customer reservation has been accepted by the residence manager. Confirmation of the reservation remains entirely at the discretion of the residence manager.
To be deemed valid, reservations must be guaranteed by an up-do-date credit card issued by a reputable establishment. For stays of over 7 nights, a deposit must be paid in addition to this condition.
The deposit amount is calculated as follows:
- For stays of between 7 and 29 nights : deposit corresponds to 30% of the total accommodation price.
- For stays of 30 nights and over : deposit corresponds to 30% of the price for 30 nights’ rental.
Article 3 - Cancellation
In the event of cancellation of the reservation, cancellation charges shall be payable ipso jure and without formalities to the Victoria Garden residence in the following cases and under the following conditions :
- Stays of less than 7 nights
In the event of cancellation less than 48 hours before the scheduled check-in date, the customer will be invoiced a cancellation charge of the cost of one night’s accommodation.
- Stays of 7 to 29 nights
In the event of cancellation less than 7 days before the scheduled check-in date, payments made will be retained in their entirety by the Victoria Garden residence.
- Stays of 30 nights and over
In the event of cancellation less than 14 days before the scheduled check-in date, payments made will be retained in their entirety by the Victoria Garden residence.
For “no shows”, i.e. customers who have not cancelled their reservation but fail to arrive at the residence as scheduled, reservations will be subject to the cancellation charges outlined above.
Article 4 - Duration of stay
The maximum limit for rental contracts is 180 nights.
The duration of the stay may be prolonged in accordance with availability and at the discretion of the residence manager. Where a stay is prolonged, a new rental contract will be signed. However, the Victoria Garden residence is under no obligation to allow the resident to remain in the same suite, nor to provide the resident with the same category of suite. In any event, the room will be invoiced at the tariff corresponding to the new suite rented. Prior to any prolongation, the customer must settle any sums payable with regard to their previous stay.
Customers may end their stay prior to the contractually agreed date, by informing the residence manager within the following periods :
- Stays of less than 7 nights : over 48 hours in advance.
- Stays of between 7 and 29 nights : over 7 days in advance.
- Stays of 30 nights and over : over 14 days in advance.
In the event that these deadlines are not adhered to, penalties equal to the cancellation charges outlined in article 3 of these conditions will be payable ipso jure and without any formalities to the Victoria Garden residence.
In the event of early check-out, the price applicable shall be the price corresponding to the duration thus shortened. Any price modifications linked to a customer’ departure shall be applied retrospectively to the customer’s account, counting from the check-in date.
Article 5 - Payment methods
Invoices must be paid in accordance with the schedule outlined in the rental contract. Invoices are made out in the name of the resident or legal person who will settle the account. The resident must be able to provide evidence that said legal person is covering the costs of their stay, failing which, the invoice will be made out in their name.
Payment options depend on the length of stay:
- Customers staying for a period of less than 7 nights must pay the price of the stay upon checking out of the residence.
- Customers staying for a period of between 7 and 29 nights shall pay half the accommodation price upon checking-in to the residence, less the deposit paid. The other half shall then be paid on check-out.
- Customers staying for a period of 30 nights or more shall pay on checking in to the residence the price of 30 nights’ rental, less the deposit paid. For stays of over 30 nights, the accommodation price will be payable in advance, by instalments of 30 nights.
Article 6 - Price
Unless otherwise stated in the rental contract, our prices are quoted including VAT, provision of accommodation, cost of utilities (water, electricity and heating) and tourist tax. Optional services are not included in the price.
Article 7 - Resident’s undertakings
The suite will be handed over to the resident in good, clean condition. Each resident should treat the rented accommodation and facilities with due care and in accordance with the provisions of this contract and the regulations of the residence posted inside the door to the suite.
An inventory is provided with each suite. Residents should point out any errors as well as any damage observed in the suite within four hours of their arrival, taking account of reception opening times.
Upon checking-out, the condition of the suite and the inventory will be verified. The customer will be invoiced for any missing or damaged items.
Residents must leave the suite clean and as they found it, failing which they will be invoiced for housekeeping time at the discretion of the residence manager.
Article 8 - Cancellation - penalty - non-renewal
This contract shall be cancelled ipso jure, without formality and without notice in the event that the resident fails to comply with any of the above-mentioned obligations. The customer will be required to leave the residence immediately and may be evicted, where necessary, with assistance from the police.
